OFFICIAL RULES AND REGULATIONS

NO PURCHASE NECESSARY TO ENTER OR WIN.  Entries for the 2019 “Fine Gardening Seminar Series Ticket Giveaway” (the “Giveaway”) sponsored by Fine Gardening^® (the “Sponsor”) will be accepted during the period beginning at 12:00 p.m. ET on Thursday, February 21, 2019 and ending at 12:00 p.m. ET on Friday, March 1, 2019 (the “Giveaway Period”). All entries must be received during the Giveaway Period. The Giveaway is open only to legal residents of the United States, including Puerto Rico and the District of Columbia, and Canada who are at least eighteen (18) years of age at time of entry (“Entrants”). The Giveaway is void where prohibited by law.

Employees, officers, and contractors (including immediate family members and members of the same household) of the Sponsor or of the Fine Gardening Seminar Series and their respective affiliated companies or subsidiaries and all other entities associated with this promotion, are not eligible.

LIMIT: One (1) entry per person is allowed throughout the Giveaway Period. Entries received from any person or in excess of the stated limitation will be void.

WINNER NOTIFICATION:  On or about March 1, 2019, one (1) winner will be randomly selected from among all the comments posted. The winner will be notified by direct message, either on Facebook or on Instagram, depending upon how they entered. Odds of winning will depend upon the total number of eligible comments received. The winner will receive the prize listed below.

Approximate Retail Value of Prize (“ARV”) = $240.00

CLAIMING PRIZE: Winner must sign and return a “Declaration of Eligibility and Liability/Publicity Release” within five (5) days of notification, or prize may be forfeited. Winner will also be required to provide proof of age. (Tennessee residents and any other state where prohibited, will not be required to sign Publicity Release as a condition of winning a prize.)

NO PRIZE TRANSFER OR SUBSTITUTION: No prize or any portion thereof is transferable or redeemable for cash. Any portion of the prize that is not used is forfeited. There will be no substitutions for the prize, except by the Sponsor, in which case a prize of equal or greater value will be substituted.

TERMS AND CONDITIONS: The Sponsor is not responsible for unavailable network, failed server or other connections, miscommunications, interrupted, misrouted or scrambled transmissions or other errors or problems of any kind whether mechanical, human, electronic or otherwise that may interfere with submitting your entry. The Sponsor assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the website during the Giveaway Period for any problems or technical malfunction of any telephone network or lines, computer on-line systems, access providers, computer equipment, software, failure of any e-mail entry to be received by the Sponsor due to technical problems or traffic congestion on the Internet or at any website, of any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material related to the Giveaway. The Sponsor reserves the right, in its sole discretion, to cancel or suspend this Giveaway should a virus, bug or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Giveaway. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Giveaway is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants must abide by these Giveaway Official Rules and Regulations to be eligible to win. By entering this Giveaway, you agree to adhere to the terms, policies and guidelines described herein.

JURISDICTION: As a condition of participating in this Giveaway, Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or the prize awarded, shall be resolved individually through the appropriate jurisdictional state or federal court in the State of Connecticut.

RELEASES: By participating in this Giveaway, entrants agree to release Sponsor and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Giveaway and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss, death or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Giveaway and/or acceptance, use or misuse of the prize.
